Terms and Conditions
Please be sure to read the complete Terms and Conditions prior to purchasing any of Wine Menu’s rare and fine wines. By ordering you are agreeing to all terms and conditions found in the winemenu.net/Wine Menu online wine store pages.
Most importantly, all buyers must be at least 21 years of age at the time of purchase.
Refund Policy:
Vintage Wine Purchases (1996 and Older): Buyer accepts all purchases of Wine Menu wines older than 1996 in an "AS IS" condition. Buyers of vintage wine should know that the industry standard for vintage wines gone badly is 4% to 7%. Wines using a cork may be ruined because of a natural fungus in the cork that produces the chemical compound trichloroanisole, or TCA. The Wine Menu shipping staff checks for TCA prior to shipping and as well buyers of wines older than 10 years of age should check for TCA prior to opening their vintage wine. TCA has an odor of moldy musty paper. If the vintage wine bottle does have TCA then the NOSE of the wine can be degraded. If TCA is heavy in the cork then the wine will be undrinkable, so make sure you check for TCA; if suspect of TCA, DO NOT OPEN THE BOTTLE but return immediately to Wine Menu in Northern California for a FULL 100% REFUND. We do not accept returns of any corked wine for any reason nor do we refund for uncorked wine until the wine is returned to Wine Menu in Northern California and it must be returned in the original packaging. Should there be a claim on any of your purchased wine from Wine Menu please write the claim in as much detail as possible and fax to 916-988-WEST or email to Wine Menu at info@winemenu.net. Wine Menu will make the sole decision on whether to refund the purchase price or to credit all or a partial amount of the purchase. Wine Menu does not accept any returns of corked wine nor refund for any reason other than the buyer receiving a written return authorization provided in the form of a return Identification number.
The prices per bottle are final and buyers cannot be outbid by any other buyer once they have completed the cart purchase information and the credit card has been debited for payment through the purchase system. Once the funds are submitted for payment and credited to Wine Menu’s Account the transaction is deemed complete between the buyer and Wine Menu and cannot be nullified except by those reasons listed below in the Correction of Errors & Inaccuracies.
The buyer agrees to the shipping charges displayed on the ordering form at time of purchase. The buyer also agrees to the 3% Packaging and Insurance charge. For orders requesting to be placed in front of all other Ground shipments by requesting Express or overnight shipping, the buyer agrees to the special treatment fee of $35. Usually a Wine Menu shipping employee must specially handle these expeditious transactions to include often making a special trip to the Federal Express Center when the Federal Express Pick up and Delivery scheduled pickup has passed for the day.
If the buyer fails to adhere to the Terms and Conditions of the purchase, Wine Menu may hold the buyer liable for the purchase price, or resell the wines after a 10 day notice is provided to inform the buyer.
In the event of false or non-payment by Buyer, or non-compliance by Buyer with these Conditions of Sale, Wine Menu reserves the right to take any and all appropriate or necessary actions including, without limitation, canceling or rescinding the transaction, reporting the defaulting Buyer to an appropriate credit reporting agency, charging the Buyer’s credit card for Wine Menu’s fees and expenses incurred in connection with the non-compliance (including the costs of the transaction itself), turning any amounts due and owing over to a commercial collection agency and/or taking any other action permitted by law. In no event shall Wine Menu be liable for any incidental or consequential damages to Buyer.
The buyers understand that their wines will be shipped out to the State and any Federally authorized designated ship-to location within 14 days after purchase; weather permitting, and all purchases, shipping costs and insurance fees have been paid. Optional shipping is available by ordering instructions, by fax or by email requests and acceptance by Wine Menu must be acknowledged to the buyer to be deemed received, understood and agreed to by the Wine Menu staff.
